이용약관

제1조 (목적)

이 약관은 순비스튜디오(이하 "회사")가 soonbistudio.com(이하 "사이트")에서 제공하는 맞춤 노래 제작 서비스(이하 "서비스")를 이용하는 데 필요한 회사와 이용자의 권리, 의무, 책임 사항을 정합니다.

제2조 (정의)

  1. "이용자"란 사이트에서 이 약관에 따라 서비스를 주문하는 사람을 말합니다.
  2. "맞춤 노래"란 이용자가 준 가사 또는 사연을 바탕으로 회사가 이용자 한 사람을 위해 만드는 노래 음원을 말합니다.
  3. "반주(MR)"란 맞춤 노래에서 목소리를 뺀 음원을 말합니다.

제3조 (약관의 게시와 변경)

  1. 회사는 이 약관을 사이트 첫 화면 아래쪽 링크로 누구나 볼 수 있게 게시합니다.
  2. 회사는 「전자상거래 등에서의 소비자보호에 관한 법률」, 「약관의 규제에 관한 법률」 등 관련 법을 어기지 않는 범위에서 약관을 바꿀 수 있습니다.
  3. 약관을 바꿀 때는 바꾼 내용과 시행일을 시행일 7일 전부터 사이트에 알립니다. 이용자에게 불리하게 바꾸는 경우에는 30일 전부터 알립니다.
  4. 바뀐 약관은 시행일 이후의 주문부터 적용하고, 그 전에 한 주문에는 주문 당시의 약관을 적용합니다.

제4조 (서비스 내용)

  1. 회사가 제공하는 상품은 다음과 같습니다.
    • 가사 직접 제공: 이용자가 준 가사로 노래 1곡 제작 (19,900원)
    • 사연으로 가사까지: 이용자가 준 사연·내용을 바탕으로 회사가 가사를 쓰고 노래 1곡 제작 (29,900원)
  2. 두 상품 모두 완성곡 음원 1곡과 반주(MR) 파일을 함께 드리고, 수정은 2회까지 포함합니다.
  3. 뮤직비디오, 음원 사이트 발매, 저작권 등록 대행은 서비스에 포함되지 않습니다.
  4. 맞춤 노래는 인공지능(AI) 음악 생성 도구를 활용해 만듭니다.
  5. 선택 옵션 "본인 목소리로 만들기": 이용자가 올린 본인 노래 녹음으로 이용자 목소리의 노래를 만듭니다. 추가 금액은 20,000원(합계: 가사 직접 제공 + 본인 목소리 39,900원, 사연으로 가사까지 + 본인 목소리 49,900원)이며, 자세한 내용은 제8조의2를 따릅니다.
  6. 노래 + 캐릭터 영상 패키지(49,900원 / 59,900원): 맞춤 노래와, 이용자의 사진을 바탕으로 만든 캐릭터 그림의 노래 영상을 함께 만듭니다. 자세한 내용은 제8조의3을 따릅니다.

제5조 (주문과 계약 성립)

  1. 이용자는 사이트의 주문서에 필요한 내용을 적고 결제하는 방법으로 주문합니다.
  2. 계약은 회사가 결제를 확인하고 주문 접수 안내를 보낸 때 성립합니다.
  3. 회사는 다음에 해당하는 주문은 받지 않거나, 접수 후에도 제작을 거절할 수 있습니다. 이때 받은 금액은 전부 돌려드립니다.
    • 기존 곡의 가사를 그대로 또는 거의 그대로 쓰는 경우
    • 특정인을 비방하거나 명예를 훼손하는 내용
    • 선정적이거나 폭력적인 내용, 혐오·차별을 부추기는 내용
    • 다른 사람의 저작권, 상표권, 초상권, 개인정보 등 권리를 침해할 우려가 있는 내용
    • 법령이나 사회 질서에 어긋나는 내용
    • 주문 내용이 불분명하거나 연락이 닿지 않아 제작할 수 없는 경우
  4. 만 14세 미만은 주문할 수 없습니다. [법률 검토 필요: 미성년자(만 19세 미만) 주문 시 법정대리인 동의 절차]

제6조 (결제)

  1. 결제는 회사가 정한 결제대행사(PG)의 결제창 또는 회사가 안내하는 방법으로 합니다.
  2. 결제 금액은 상품 페이지에 표시된 금액이며, 부가가치세가 포함되어 있습니다. [법률 검토 필요: 과세 유형에 따른 부가세 표기]

제7조 (제작과 전달)

  1. 회사는 결제 확인 후 24시간 안에 완성곡을 만들어, 이용자가 주문서에 적은 이메일 또는 카카오톡으로 그 주문 전용 듣기 링크(soonbistudio.com/listen/…)를 보냅니다. 듣기 링크에서는 음질을 낮추고 짧은 안내 소리("soonbi music")를 넣은 미리듣기본만 들을 수 있고, 이용자가 확정하고 결제가 확인되면 원본 음질 완성곡과 반주(MR) 파일을 내려받을 수 있습니다.
  2. 이용자가 원한 마감일이 결제 확인 후 24시간보다 촉박하면 회사가 미리 연락드립니다. 회사 사정으로 결제 확인 후 24시간 안에 전달하지 못하면 이용자는 전액 환불을 요청할 수 있습니다.
  3. 이용자가 연락처를 잘못 적어 전달하지 못한 경우의 책임은 이용자에게 있습니다.
  4. 듣기 링크는 마지막으로 전달한 날부터 30일 동안 열리고, 그 뒤에는 링크와 파일이 모두 삭제됩니다. 이 기간 안에 완성곡을 내려받아 주세요.

제8조 (수정)

  1. 완성곡을 받은 뒤 듣기 링크의 [수정 요청]으로 2회까지 수정을 요청할 수 있습니다. 고친 곡은 같은 링크로 다시 전달합니다.
  2. 수정은 가사 일부 고치기, 분위기·빠르기 조정, 다시 만들기 등 처음 주문한 내용 안에서 합니다. 장르, 보컬 성별, 언어를 바꾸거나 가사 전체를 바꾸는 것은 새 주문으로 봅니다.
  3. 완성곡을 받은 날부터 [14]일 안에 확정이나 수정 요청이 없으면 확정한 것으로 보고, 결제가 확인된 주문은 다운로드를 엽니다. [대표 결정 필요: 수정 요청 기한]
  4. 이용자가 듣기 링크에서 [이 노래로 확정]을 누르면 그 뒤에는 수정을 요청할 수 없습니다.

제8조의2 (본인 목소리로 만들기 옵션)

  1. 이용자는 반주 없이 본인 목소리만 녹음한 노래 파일 2~5개(한 파일 30초~3분)를 회사가 안내하는 방법으로 올립니다.
  2. 회사는 녹음을 들어 보고 제작 가능 여부를 이용자에게 알립니다. 가능하다고 알린 뒤에 결제하며, 불가능하면 결제하지 않습니다.
  3. 이 옵션의 완성곡은 결제 확인 후 36시간 안에 전달합니다. 36시간 안에 전달하지 못하면 이용자는 전액 환불을 요청할 수 있습니다.
  4. 이용자는 본인의 목소리만 올려야 합니다. 다른 사람의 목소리를 올려 생긴 문제는 이용자가 책임지며, 회사는 이를 알게 되면 제작을 중단하고 녹음을 바로 삭제합니다.
  5. 회사는 녹음과 그것으로 만든 목소리 모델을 그 주문의 노래를 만드는 데만 쓰고, 완성곡 전달 후 30일 안에 모두 삭제합니다. 다른 노래·광고·학습 등에 쓰지 않습니다.
  6. 녹음 상태에 따라 목소리가 원래와 다르게 들릴 수 있습니다. 이는 수정 2회 안에서 조정합니다. [법률 검토 필요: 음성 이용 동의 방식]

제8조의3 (노래 + 캐릭터 영상 패키지)

  1. 회사는 맞춤 노래 1곡과, 이용자가 보낸 사진을 바탕으로 만든 3D 치비 캐릭터 그림에 은은한 움직임·장식과 노래·자막을 더한 노래 영상을 만듭니다. 캐릭터가 걷거나 말하는 애니메이션은 포함되지 않습니다.
  2. 가격은 가사 직접 제공 49,900원, 사연으로 가사까지 59,900원입니다. 본인 목소리 옵션을 붙이면 +20,000원(69,900원 / 79,900원)이고 제작 기간은 똑같이 48시간입니다. 이 경우 사진과 함께 녹음도 올리고, 녹음은 제8조의2에 따라 확인합니다.
  3. 순서는 주문 → 사진 올리기 → 캐릭터 그림 확인(1회) → 결제이며, 회사는 결제 확인 후 48시간 안에 듣기·보기 링크로 전달합니다. 48시간 안에 전달하지 못하면 이용자는 전액 환불을 요청할 수 있습니다. 노래 수정·확정·다운로드는 제7조와 제8조를 따릅니다.
  4. 이용자는 본인 사진이거나 사진 속 사람에게 허락을 받은 사진만 보내야 합니다. 허락 없이 다른 사람의 사진을 보내 생긴 문제는 이용자가 책임지며, 회사는 이를 알게 되면 제작을 중단하고 사진을 바로 삭제합니다.
  5. 회사는 사진을 그 주문의 영상을 만드는 데만 쓰고, 완성 영상 전달 후 30일 안에 삭제합니다. 다른 작품·광고·AI 학습에 쓰지 않습니다.
  6. 캐릭터 그림은 AI를 활용해 만들어 사진과 똑같이 닮지 않을 수 있습니다. 회사는 결제 전에 캐릭터 그림을 먼저 보여 드립니다.
  7. 유명인, 기존 캐릭터, 브랜드 로고가 들어간 요청과 제5조 3항에 해당하는 요청은 받지 않습니다. [법률 검토 필요: 초상권·얼굴 사진 이용 동의 방식]

제9조 (청약철회와 환불)

청약철회와 환불은 별도의 환불 규정을 따릅니다.

제10조 (저작권과 이용 범위)

  1. 맞춤 노래는 AI를 활용해 만들기 때문에, 이용자에게 저작권의 독점(유일한 권리)을 보장하지 않습니다. 비슷한 멜로디나 소리가 다른 곳에서 만들어질 수 있습니다.
  2. 이용자는 받은 완성곡과 반주를 개인적인 용도(선물, 행사, 개인 SNS 게시 등)와 본인 가게·사업의 홍보에 자유롭게 쓸 수 있습니다.
  3. 이용자는 완성곡을 음원 사이트에 발매하거나 판매하거나, 저작권 등록을 하거나, 다른 사람에게 판매할 수 없습니다. [법률 검토 필요: AI 생성곡의 권리 귀속과 이용 허락 범위, 사용한 AI 도구의 이용 조건과 맞는지]
  4. 이용자가 준 가사·사연에 대한 권리와 책임은 이용자에게 있습니다. 이용자가 준 가사가 다른 사람의 권리를 침해해 생긴 문제는 이용자가 책임집니다.
  5. 채널 업로드: 회사는 이용자가 주문서의 "완성작을 Soon & Bi 채널에 올려도 될까요?"에 동의한 경우에만 완성작을 회사 유튜브 채널(노래는 soonbi MUSIC의 「제작의뢰곡 (Custom Songs)」 목록)에 올립니다. "동의(이름·사연 가리고)"를 고르면 이름과 사연을 빼고 올리고, "비동의"면 어디에도 올리지 않습니다. 이용자는 듣기 링크에서 확정할 때 이 선택을 바꿀 수 있습니다. 올린 뒤에도 이용자가 요청하면 회사는 지체 없이 내립니다.

제10조의2 (후기)

  1. 후기는 듣기 링크에서 노래를 확정하고 완성본을 내려받은 이용자만 남길 수 있습니다.
  2. 후기는 이름을 가려서(예: 김○○) 별점, 글, 용도와 함께 사이트에 보여 줍니다. 회사가 확인한 뒤 올리며, 욕설·개인정보·광고가 들어간 후기는 올리지 않을 수 있습니다.
  3. 회사는 후기를 만들어 내거나 내용을 바꾸지 않습니다. 이용자는 언제든 자신의 후기 삭제를 요청할 수 있습니다.
  4. 후기를 남긴 이용자에게는 별점과 관계없이 다음 주문에 쓸 수 있는 할인 쿠폰(현재 5,000원, 90일)을 드립니다. 후기를 올릴지는 별점이 아니라 2항의 기준으로만 정하며, 사이트에 후기 작성 혜택을 함께 표시합니다. [법률 검토 필요: 「추천·보증 등에 관한 표시·광고 심사지침」의 경제적 이해관계 표시 방법]

제10조의3 (할인 쿠폰)

  1. 쿠폰은 회원가입 없이 쿠폰 코드로 씁니다. 주문서의 [할인 쿠폰] 칸에 코드를 넣으면 결제 금액에서 쿠폰 금액을 뺍니다.
  2. 쿠폰은 한 번만 쓸 수 있고, 표시된 기간이 지나면 쓸 수 없습니다. 한 주문에 한 장만 쓸 수 있고, 현금으로 바꾸거나 다른 사람에게 팔 수 없습니다.
  3. 쿠폰은 결제가 확인될 때 사용한 것으로 처리합니다. 쿠폰을 쓴 주문을 환불하면 실제로 결제한 금액만 돌려드리고, 쿠폰 기간이 남아 있으면 쿠폰을 다시 쓸 수 있게 돌려드립니다.
  4. 쿠폰 코드를 잃어버리거나 다른 사람이 먼저 쓴 경우 회사는 책임지지 않습니다. 부정한 방법으로 얻은 쿠폰은 쓸 수 없습니다.

제11조 (회사와 이용자의 의무)

  1. 회사는 법령과 이 약관을 지키며, 주문 내용대로 성실하게 노래를 만듭니다.
  2. 이용자는 주문서에 사실대로 적고, 다른 사람의 개인정보나 권리를 침해하는 내용을 넣지 않습니다.

제12조 (책임의 제한)

  1. 천재지변, 정전, 이용 중인 외부 서비스의 장애 등 회사가 어쩔 수 없는 사유로 서비스를 제공하지 못한 경우 회사는 책임을 지지 않습니다. 다만 이때 아직 전달하지 못한 주문은 전액 환불합니다.
  2. 회사는 노래의 음악적 취향(마음에 드는지 여부)에 대해서는 수정 2회로 대응하며, 취향 차이만으로는 환불하지 않습니다. 자세한 내용은 환불 규정을 따릅니다.

제13조 (분쟁 해결)

  1. 회사는 이용자의 불만과 의견을 이메일(soonbi.studio@gmail.com)로 받고, 빠르게 처리합니다.
  2. 회사와 이용자 사이의 분쟁은 한국 소비자원 등 소비자 분쟁 조정 기관에 조정을 신청할 수 있습니다.
  3. 소송이 필요한 경우 「민사소송법」에 따른 관할 법원으로 합니다. 이 약관은 대한민국 법을 따릅니다.

부칙

Terms of Service

This English version is provided for convenience. If it differs from the Korean version, the Korean version prevails.

1. Purpose

These terms set out the rights, duties and responsibilities of SoonBi Studio ("we") and users when using the custom song service ("Service") on soonbistudio.com.

2. Definitions

  1. "User" means a person who orders the Service under these terms.
  2. "Custom song" means a song recording we make for one user, based on the lyrics or story the user provides.
  3. "Instrumental (MR)" means the custom song without vocals.

3. Posting and changes

  1. These terms are linked at the bottom of every page.
  2. We may change these terms within the limits of Korean consumer protection law.
  3. Changes are announced on the site 7 days before they take effect (30 days if the change is unfavorable to users).
  4. Orders placed before a change follow the terms in effect at the time of the order.

4. The Service

  1. Products:
    • Your Lyrics: one song made from lyrics you provide (KRW 19,900 / USD 14.99)
    • Your Story, Our Lyrics: we write the lyrics from your story and make one song (KRW 29,900 / USD 21.99)
  2. Both include the finished song, a free instrumental (MR) file, and up to 2 revisions.
  3. Music videos, release on streaming services and copyright registration are not included.
  4. Custom songs are made with the help of AI music tools.
  5. Option "Your own voice": we make the song in your voice from recordings you upload. Extra fee KRW 20,000 / USD 14 (total: Your Lyrics + own voice KRW 39,900 / USD 28.99; Your Story + own voice KRW 49,900 / USD 35.99). See section 8-2.
  6. Song + Character Video Package (KRW 49,900 / 59,900; USD 35.99 / 42.99): a custom song plus a song video with a character illustration based on your photo. See section 8-3.

5. Orders

  1. You order by filling in the order form and paying.
  2. The contract is formed when we confirm payment and send you an order confirmation.
  3. We may refuse or cancel an order (with a full refund) if it: copies lyrics from existing songs; insults or defames anyone; contains sexual, violent or hateful content; may infringe others' rights (copyright, trademark, portrait, privacy); breaks the law; or cannot be made because details are unclear or we cannot reach you.
  4. Children under 14 may not order. [Legal review needed]

6. Payment

Payment is made through our payment provider's checkout or by the method we announce. Prices shown include VAT. Customers using the English screen see US dollar prices; until international payment (PayPal/card) is available, we send a payment link after the order. [Legal review needed]

7. Production and delivery

  1. Within 24 hours after payment, we send a private listening link for your order (soonbistudio.com/listen/...) by email or KakaoTalk. On that page you can only play a preview (lower quality, with a short "soonbi music" voice tag). After you confirm and payment is checked, you can download the full-quality song and the instrumental (MR).
  2. If your deadline is sooner than 24 hours after payment, we will contact you first. If we fail to deliver within 24 hours after payment, you may request a full refund.
  3. We are not responsible if delivery fails because you entered wrong contact details.
  4. The listening link works for 30 days after the latest delivery; then the link and files are deleted. Please download your song within that time.

8. Revisions

  1. You may request up to 2 revisions after delivery with [Request a revision] on the listening page. The revised song is delivered to the same link.
  2. Revisions stay within the original order (small lyric edits, mood or tempo adjustments, regeneration). Changing genre, vocal gender, language, or the whole lyrics counts as a new order.
  3. If you neither confirm nor request a revision within [14] days of delivery, the song is treated as confirmed and, if payment is confirmed, the download opens. [Owner decision needed]
  4. Once you press [Confirm this song], no more revisions can be requested.

8-2. Own-voice option

  1. You upload 2 to 5 recordings of yourself singing, voice only without a backing track (30 seconds to 3 minutes each), by the method we provide.
  2. We listen and tell you whether it works. You pay only after we confirm; if it does not work, you pay nothing.
  3. With this option, the song is delivered within 36 hours after payment. If we fail to deliver within 36 hours after payment, you may request a full refund.
  4. You may upload only your own voice. You are responsible for any problem caused by uploading someone else's voice; if we learn of it, we stop production and delete the recordings immediately.
  5. Your recordings and any voice model made from them are used only for this order and are deleted within 30 days after delivery. They are never used for other songs, advertising or training.
  6. Depending on recording quality, the voice may sound different from yours; this is adjusted within the 2 revisions. [Legal review needed]

8-3. Song + Character Video Package

  1. We make one custom song and a song video with a 3D chibi character illustration based on your photo: the illustration with gentle motion and decorations, plus the song and subtitles. It is not an animation in which characters walk or talk.
  2. Price: KRW 49,900 / USD 35.99 (your lyrics) or KRW 59,900 / USD 42.99 (your story, our lyrics). With the own-voice option +KRW 20,000 / USD 14 (KRW 69,900 / 79,900; USD 49.99 / 56.99), still 48 hours; you also upload recordings, checked as in section 8-2.
  3. Steps: order, upload photos, check the illustration (once), pay. We deliver through your private listen & watch link within 48 hours after payment; if we miss it, you may request a full refund. Song revisions, confirmation and downloads follow sections 7 and 8.
  4. Send only photos of yourself or of people who gave you permission. You are responsible for problems caused by sending others' photos without permission; if we learn of it, we stop production and delete the photos immediately.
  5. Photos are used only for that order's video and are deleted within 30 days after delivery. They are never used for other works, advertising or AI training.
  6. Illustrations are AI-assisted and may not look exactly like the photo. We show you the illustration before payment.
  7. We do not accept requests involving celebrities, existing characters, brand logos, or anything listed in section 5.3. [Legal review needed]

9. Cancellations and refunds

10. Copyright and use

  1. Because songs are AI-assisted, we cannot guarantee exclusive copyright. Similar melodies or sounds may be generated elsewhere.
  2. You may freely use the song and instrumental for personal purposes (gifts, events, personal social media) and to promote your own shop or business.
  3. You may not release the song on streaming services, sell it, register its copyright, or resell it. [Legal review needed]
  4. You are responsible for the lyrics and stories you provide.
  5. Channel upload: we post your finished work on our YouTube channel (songs go into the "Custom Songs" playlist on soonbi MUSIC) only if you agreed on the order form ("May we post the finished work on the Soon & Bi channel?"). If you chose "Yes (hide names and story)", we remove names and story; if "No", we post it nowhere. You can change your choice when you confirm on the listening page. Even after posting, we take it down without delay if you ask.

10-2. Reviews

  1. Only users who confirmed and downloaded their song on the listening page can leave a review.
  2. Reviews are shown with a masked name (e.g. K○○), star rating, text and purpose, after we check them. We may decline reviews containing abuse, personal data or advertising.
  3. We never write or edit reviews ourselves. You can ask us to delete your review at any time.
  4. Users who leave a review receive a discount coupon for their next order (currently KRW 5,000 or USD 3.99, valid 90 days), regardless of the rating. Whether a review is posted depends only on the rules in item 2, never the rating, and the site discloses this benefit. [Legal review needed]

10-3. Discount coupons

  1. Coupons work with a code, no sign-up. Enter the code in the [Discount coupon] box on the order form and the coupon amount is taken off.
  2. A coupon can be used once, only before its expiry date, one per order. It cannot be exchanged for cash or sold.
  3. A coupon counts as used when payment is confirmed. If an order with a coupon is refunded, we refund the amount actually paid and, if the coupon has not expired, make it usable again.
  4. We are not responsible for lost codes or codes used by someone else first. Coupons obtained dishonestly cannot be used.

11. Duties

We follow the law and these terms and make your song faithfully. You provide truthful information and do not include content that infringes others' rights or privacy.

12. Limitation of liability

  1. We are not liable for failures caused by events beyond our control (natural disasters, outages, third-party service failures). Undelivered orders in such cases are fully refunded.
  2. Differences in musical taste are handled through the 2 revisions and are not by themselves grounds for a refund.

13. Disputes

Contact us at soonbi.studio@gmail.com. Disputes may be brought to Korean consumer dispute mediation bodies. These terms are governed by the laws of the Republic of Korea, and the competent court is determined under the Korean Civil Procedure Act.
